Gurus Help needed, Change of Employer

My I-485 is pending with VSC with RD 01/15/2002.
I am working for a consulting company and I have to join the client starting from Oct 15th. Otherwise I need to look for a job. You know what I am talking.

My current employer doesn’t have any problem with that and certainly cooperates with me till I get my GC.

The profile of the job is same. Location is different from where Labor is filed. The salary is slightly (about 15%) less than I am currently getting. My client claims that they have excellent benefit package compared with my consulting company and salary is on par with what I am getting now if I include the benefits.

Obviously I may need to use AC21 to change the employer.

The question before me is can I join my client?
Even there is a minute chance of putting my I-485 approval in jeopardy I don’t want to take chances.
This is the best opportunity I can get from my career point of view. That is the reason why in the first place I am considering joining my client.

Thanks for reading the long mail. I appreciate your response in this regard.

Best wishes to all.

chances

You need everything to be perfect without any risk, have you ever seen that hapening in the real life???

You said: " ...Otherwise I need to look for a job. You know what I am talking. " and for AC21, "Even there is a minute chance of putting my I-485 approval in jeopardy I don’t want to take chances."

Aren't you copntradicting your statements? If you have to look for a new job, you are already putting I-485 approval in jeopardy.

If you think you will lose your job
- You will be laid off without this client's contract.
- If that is the only option you think you will have.
- If that is absolutely, 100% sure thing to happen, and there is no chance to continue with the sponsor.

Then you need to take some risk. You need to join the client. The salary and location have not been mentioned in AC21. As long as your job description is same, you're making your case much stronger. But, if you don't have a job, you are making your case very very very weak.

Career vs. Green Card

Ok I am not sure what comprises of a successful career. For me
1). Money.
2). Job Security.
3). Environment.
4). Growth Potential
all of the above comprises of a successful career. I would recommend you to stick with your current employer because "patience is virtue". There will be 100X more opp once you get your green card. With RD in Jan 2002, you can expect your green card in Jan 2003. I tend to be risk averse when it comes to things like Green Card, especially when you are so close to getting one, vagaries of a vagabond is what you might want to avoid in this special situation. From what you said, money is not there in your new job, and in this economy I rather someone give me cash in my pocket rather than promises and "What if" scenarios. Just a thought that you might want to hang low and aim high once you get your green card.

I agree with twilo2000

I would rather be with the old employer until I get GC (in your case, might be a couple of months), becuase you don't want to take any chance with GC process.
