Guidance on checking my I-485 status

Hi GP111/Gurus,

I need your guidance on checking my I-485 status ( especially the dreaded FBI Name/background check ) . I was born in India but have filed my I-485 on 1/7/2006 on the basis of Cross-Chargeablity.

The issue of Cross-Chargeablity is a bit 'iffy' with AOS and I was hoping to get it approved using my own PD ( 4/1/2003 ) instead of relying on Cross-Chargeablity. I was hoping and even confident that my PD would become current as per the June Visa bulletin. All such hopes were dashed on 5/12/06 when EB2 India came to a dead halt with pointers for even possible future retrogression. ( I have always ended up missing the bus in this GC journey....SF DOL => BEC, rcvd LC hardcopy on 10/1/2005, June 2006 Visa bulletin,...? )

Questions:
1. I have heard that one should only inquire about the I-485 status with the 1800 number after the PD becomes current. My dilemma...My PD can be current ( based on Cross-Chargeablity ) or not based ( based on my own PD ). Can I call the 1800 number anyway? Will there be any negative side effects if TSC determines that I have been bugging them even before my PD is current.

2. It seems that the CSC E-Mail address ( CSC-XII.485@dhs.gov) is much more useful to get an accurate 485 status information than the 1800 number. Can I send an e-mail to CSC even though my 485 application was transferred to TSC. Do they even respond to non CSC cases / will it cause any issues.

3. How often can I call the 1800 number?

4. Are you aware that USCIS has been approving 485 cases recently based on CC? They seem to be accepting tons of applications using CC anyway. Is accepting the 485 application using CC a guarantee that it will be adjucated using CC?

THERE IS NO SUCH RULE (ABOUT PD BEING CURRENT FOR INQUIRY). BUT they will only answer inquiry if your ND/RD is 30 day beyond Current Processing dates. So check TSC processing dates & inquire if your ND is beyond processing time

The response will be "case has been transferred to VSC"

No such rule, but once you inquire you should wait for 30 more days

YES. They have never denied valid CC

There is no problems with using CC, so I would not worry about your own PD being current/retrogressed now.
