*Guidance needed for my Green Card Process **

Hello,
My current company is not willing to sponsor for my GC. I have still 4 years left on my H1B. My colleague at work owns a small company (he does not have any full time employees, he hires only contract workers) but he is willing to help me out on my GC Process (via the future employee green card process). My questions are

1. First, what are the requirements for sponsoring a GC? (Since he does not have any fulltime employees at his company, is he eligible to sponsor for my GC?; he has not sponsored any GCs before would that be a problem? is there a benchmark turnover he is expected to have?).

2. What are the questions that I should ask him about his company to make sure if he can in fact sponsor for my GC?

I would really appreciate your guidance in this matter.

1. His company needs to be paying taxes to IRS, needs to show good cash flow (not necessarily profits but money coming in against expenditure), an Office (not in his house but in a business Suite), having at least six months of your proposed salary if you ever become his full time employee!

All not all are required, they are "preferred" by USCIS in case of any queries. USCIS would not want to encourage uncle/aunt's businesses to process GC for their niece's and nephew's, if you know what I mean.

2. You should make the decision if he is willing to support you to through the process. He should be able to signed on dotted lines for LCA, I140, employment letters, RFE's, queries from USCIS etc.

Above all hire a good/competent attorney - spend some money that is - to cover all questions that you may have + the ones you need to ask yourself & your friend before shelling out K's of Dollars on your GC process.
