Greencard issue....please reply....

Hi All,

I was filed as a dependant on my spouse's GreenCard. However he wants to divorce me. We are a few months away from our stamping. Can someone please tell me what will happen to my status if he files for a divorce before the stamping?

Hi Malavika,

If your husband decides to remove your name has a dependant on his GreenCard application he can very much do so and unfortunately there is very little you can do about it.

However If he has been abusive in the marriage you can document his abuse and then independently file the I360 battered spouse petition for your permanent residence (with the Vermont Service Center).
