Hi All,

please advice.

My cousin is working as a Software Engineer in a well reputed organization in India.His total IT experience includes 5 years.

Can anyone please advice is it possible to file a green card petition for him from US(with no H1 visa).Assume that one employer in US is ready to sponser his green card.

My questions are:

1)Is there any immigration law that allows to file green card for a foreign individual who is not actually residing/working in US?
2)If so,what is the procedure
3)What is the probability of success rate?

All comments and advises are highly appreciated.

This is the wrong forum, but anyways:

1) There is no law that says you have to be in the US. Sponsorship of people outside the country is done all the time. The petition is for *future* positions.

2) The procedure is exactly the same as if he was in the US except that he will have to obtain an immigrant visa instead of doing Adjustment of Status (CP is usually faster than AOS anyways). He probably won't be allowed to enter the US for business or pleasure during this time, though.

3) Same as if he was in the US.
