As market is bad, if i am on bench and not paid salary by company A, does it effect my green card with other company B.

for how long can i go to india with my green card going on with other company B and employment with company A just to be safe in case i am on bench

I am in california, EB3, RIR.

The law requires the employer to have an IMMEDIATE job opening and to be able to place you on the payroll immediately following immigration. If your employer can meet these requirements, then you will have no problem. The issue, always, is credibility of the employer\'s claims when you have employment authorization and are not working for the sponsoring employer.

As long as you are not out of status you can go to India. I-485 stage you should go with AP.

CSC is not bad in timing. VSC are TSC are horrible.
Please refer to http://www.immigration.com/processing-times/ca.html
for I-140 and I-485 processing time.
For LC (SESA) refer http://www.immigration.com/processing-times/sesa.html
LC (Federal) refer http://www.immigration.com/processing-times/dol.html

I don\'t think it matters at all

Your entire GC process can be completed with Company B, even if you don\'t work for company B and even if you are in iNDIA, whether you get paid or unpaid by company A. As long as company B supports you and in reasonably healthy financial situation and your legal status and records are good yopu don\'t have any problem. As per the law you need to work for company B for 2 years after getting the Green card. But if you are in good understanding it may not matter.

I checked with several attorneys in the past and I know some people who have taken this route and getting green cards.

How long a person can stay in US on unpaid leave

I am on bench right now. Dont know when will I get another project. My I-140 is pending at VSC and I am thinking of taking unpaid leave and meanwhile the company can look for a project. This way I can continue my GC.

My question is what is the max limit in taking unpaid leave on H1 while staying in US

HI Raji

As chuck mentioned you can process do the entire process with company B. And depending on the method the GC is being processed, you may have to be in US after particular stage. This what i understand from my old employer and attorney.
