Green card with two companies, at the same time??

My friend is being offered the opportunity to start GC process with another company immediately based on a future job offer (ie. without switching jobs now). At the same time her current employer promises to start her GC process in six months. If she goes ahead with both, then soon she\'ll have two applications filed with DOL or INS for her at the same time. Is that legally permitted, and is that practically a good idea?

Thanks,
GM

It is possible

One of my friend faced the same problem. It is perfectly legal to have two GCs filed at the same time , even at the same processing center. Even in I140 stage.

As GC is related to the company not to an individual, a company who filed a GC for u can change its mind and can use that GC for someother employee of that company who has the same skills and qualifications as yours. So, you can apply for multiple GCs and its perfectly legal.

Can a same employer apply GC for the same employee at two different
DOLs?(Assuming the employer has two different branch offices in two locations)

Thanks

Not possible

One employee can have only one GC Labor filed through one company. It is illegal to process two different Labor applications at different geographical locations for same company.

It is possible at the same location.

In my case my lawyer first applied for Labour in EB-2, since I already had 5 years of experience. But, she wasn\'t confident of that and then she has applied for labour in EB-3 also at the same location.

That may be a problem

Find out from your lawyer whether she changed the status of petition or she filed a totally new petition. She might get a query asking which location this candidate is required to work and what are the qualifications required for that position. These qualifications are the ones which are published in the ads in the stage of labor.

Hope this helps.
