I am on H-1. My wife completed her Masters in Graphic Design and is currently in her OPT. She has been doing some web site and banner design on commission basis. I checked with a lawyer and he said that it is perfectly legal for here to do this as a business as it is related to her field of study.
The question that I have is that when I file my taxes at the end of this year, is it better to file it under "Married filing jointly" or "Married filing separately". The reason why I am asking is that I don't want any kind of complications when it comes time for my Green Card processing. (My company filed my labor in Jan 2004). In I-140 or I-485 stage, do they look at my tax returns?
