I did it! I got my green card :-) EB3, rest of world (UK), TSC.

PERM labor cert for an IT job in CA filed in about Sept 2005. 8 years experience, but unfortunately the job description was worded such that it worked for EB3, but could have failed for EB2. I attemped to get an EB3 green card some years ago which got to an approved I140, so I applied for this green card using the earlier priority date of September 2000, which kept me out of retrogression. I filed I140, I485, and EAD all concurrently due to my early priority date.

I140: filed 5/16/06. LUDs: 5/18, 6/6, 6/7. I140 was issued with the WRONG priority date which had me on retrogression. My lawyer didn't seem to be able to fix it, but my call to the TSC got their advice on how to fix it - write to TSC addressed to case officer <number> who had my file, then a new I140 was issued with the correct ealier priority date with LUDs 8/25 and 8/29.

I485: LUDs: 5/31/06, 7/8, 8/24, 2/8/07, 2/9

I made an info pass apointment in Nov 06, and found out that my FBI name check had been sent early on (August) but was not approved, so I figured I was in the slow lane and would have to wait another 12-18 months. But then last week "Card Processing Ordered" status on 2/8 bought the suprising news, and "Approval Notice Mailed" on 2/9 to confirm.

Green Card received in mail: 2/12/2007. It's in my pocket right now :-)

Thanks to everyone who posted information and encouragement on this forum. I ended up with a mediocre attourney, and all the information on the Internet really helped a lot. In fact without this forum, Google, murthy.com, etc it would not have been possible.

Mark.

:) Congratulations markofjohnson!

Your approval is giving me some hope... (my receipt date is 2 months - ish after yours..)

Probably your name check has been initiated after your EB3 was filed. So it saves you time after your EB2 was filed.

Well, maybe the FBI already had done a name check for me, but I don't think so. My earlier green card attempt was for Consular Processing, not adjustment of status, so name check would have been initiated by the London US Consulate, but I never made it to that final appointment because I lost my job right before it. My name check took about 6 months.

You can find out when your name check request was sent and when it was complete by doing an info pass, or by getting lucky on the phone to TSC and getting through to a sympathetic phone operator. They can look up name check status by your A#.
