My current company(A) has filed my green card and I have an approved I140 thru them..just waiting on 485 to open up.

Now I am getting a Full Time Employment with a good company(B), my dilema is wheter to switch..

1. Company B will be doing my GC and have to start from scratch. I heard now a days labor is taking a year to get approved..Is that true ??

2. While i am waiting on my labor with company B and the 485 dates becomes current, can I file for 485 using company A's 140. Company A has agreed not to cancel I140 and will cooperate in paper work
Is that allowed by USCIS since I quit the company A which did the labor and I140

Thanks
Murthy

If your new company starts the new process, they will need to file a new LC and once the LC is approved, you can do a "recapture" at the I-140 stage by submitting a copy of your I-140 approval notice for the previous company.

And yes, cases are pending for approx 1 year right now. For audited cases, as long as 2 years and counting!
