I am a green card holder and am planning to marry a girl in US who is on 5 year multiple entry visitor visa.

After getting married, can I file for her immigration for permanent residence without her leaving the US. Can she live in US while her application is in process for approval?

If not, What are my other options
Please update me.

Thanks,

thx for response JoeF, so if she wants to convert her B1 visa to F1 if she gets admission in school here, does she have to leave US to get F1 or she can get it in US.

thx again

She can't just convert her visa from a B-1 to a F-1. She would need to apply to the universities here and upon acceptance, the school would then issue her a F-1 visa. This could be a very long process depending on the program and school that she's applying to. Also, she would most likely be denied the F-1 visa if she gets accepted to the school after your marriage. The F-1 visa is a non immigrant visa and her marriage to a US resident shows immigration intent.

So, the best thing to do is for her to apply, get accepted, and then move here to commence her studies before you guys get married. You should also apply for your naturalization as soon as you are eligible so as to speed up the process of your spouse getting her status adjusted.

You may also want to sign the below petition to voice your concern about this issue regarding spouses of green card holders. Rajiv is trying to gather support and put all that together for submission to different members of the Congress.
