Hi,

I am planning to travel to India in august for 3 weeks and I have my AP and EAD with me.Incase my green card gets issued in august(the dates show we are current), will I be able to return using my AP or will my AP expire as my GC got approved? My lawyer's assistant says that once GC gets authorized AP will expire. So does this mean its best to cancel the trip?

Thanks.

Various law offices have advised that you may still use the AP document to return to the US even if your I-485 is approved while abroad. Remember that once your I-485 is approved, your status changes to 'lawful permanent resident' whether or not you happen to have your card in your pocket. One lawyer, Murthy.com, advises that it's better to travel on AP instead of H-1B visas when you are expecting an approval. Your AP may indeed become 'invalid' (not expired), but it is still useful because 1- it enables you to board the plane and 2- it establishes your identity and your A# at the US port of entry and enables the immigration officers to identify you as an LPR and admit you.

By the way, you mention that you also have your EAD with you. Having your EAD is completely unrelated to traveling.
