To who ever can help me with my miserable case:
My wife had applied for my permanent Visa on July 2005.
We had an interview on May 2005 and my I-130 was approved!!!
However, I haven't received my green card yet due to security background check. I keep on renewing the employment authorization card and the traveling documents, but how long will I have to do it for? This is unbelievable!!!
I took the following actions:
1.I sent a letter to the congressman, and they replied that it is still security background check pending.
2. I sent a letter to the U.S Department of Justice - FBI, asking them to send me report on my first and last name through the Freedom of Information-Privacy Act (FOIPA). Once I recieved their response, which was - clean background - I sent it to the Immigration office dealing with my case (Miami).
3. I sent a letter to the Miami immigration office (head officer And regional officer) with the facts, including the FOIPA clean background report, and told them I will send a mandamus lawsuit if they don't give me an answer. They replied after a month, saying that the processing of my case is being delayed and that there is still investigation into my background. They asked me to call again their 1-800 number in 6 months, which will be at the end of March 2008.
What can I do?
Should I send a mandamus suit or should I wait to March 08?
Can I use the mandamus suit before 2 years from my initial interview had passed?
Please help me here, I'm lost with this case. How long should I wait for?
