Green Card holder with baby on the way

Hi,

I have a unique situation I think and I can't find an answer anywhere. I am a green card holder and my wife is a Canadian citizen. I will get my citizenship for the US in a year and our delivery date is Dec 1st. I have not applied for my wife yet because I am waiting on my citizenship. This allows her to travel between US and Canada without many issues.

My question is regarding the baby's status if delivered in Canada vs USA. if the baby is delivered in USA I know it will have dual citizenship immediately, but what if it is delivered in canada? Is there any benefit of me having a green card or getting my citizenship within a year?

The reason we are considering Canada is because the delivery will be covered where as in USA it will cost upwards of $5000 with our high deductible insurance.

Can someone answer if there is any benefit of me being a green card holder or becoming a citizen within a year? I have searched everything and kind find an answer.

If the baby is born in Canada, and you are not a US citizen at the time it is born, then the baby will not have US citizenship at birth. It will just have Canadian and whatever your nationality is (if it's not Canadian).

Not really, other than being able to petition your wife and child to immigrate. If you got US citizenship before the child is born then it will have US citizenship at birth (but I don't think that's possible from what you said); but it doesn't matter in the end because all of you will immigrate to the US in the end anyway.

Actually, depending on whether you got married before or after you got your permanent residency, and depending on how you got your permanent residency, you might not even need to separately petition your wife in order for her to immigrate.

If you need to petition your wife (and possibly child), spouse and minor child of citizen is in the Immediate Relative category and has no wait; spouse and minor child of a permanent resident is in the F2A category which has a wait of 1.5 years.
