Green card holder out of US because of Life-threatening event and Covid-19

Hi Good day!

I'm holding a PR status in the US. I went for a vacation June 2018 in the philippines and I was going back on January 2019 after holidays, My elder brother who is in the force was in danger together with his family, Feared for there safety I stayed for a while just to make sure they're safe . March 2019 he was on his case, he was assasinated by the gang he was on the case. Broke our families and things where never been the-same again. I finally get hold of myself and want to move on with my life and go back to US. but covid-19 came and I got stuck in Hong kong from the travelling. I schedule going back keep pushing but the virus was not backing down. Now I am ready to comeback no matter what. I would like to inquire if I can still comeback to US. I am temporary visa here in Canada.

I'm sorry for your loss. Unfortunately, I don't think your chances of proving non-abandonment of your residence in the US are very good. A LPR is expected to maintain their primary residence in the US, and staying abroad for a few months to mourn the passing of a relative is understandable, but in your case it must have been 10+ months (or whatever length of time it was between your brother's death in March 2019 and Jan 2020 when flights began to be suspended) and this gives the appearance that you had no ties to the US compelling you to return and you did not, at the time, consider the US to be your primary residence. However, since you obviously do want to return to the US now, you should consult an immigration lawyer who will be able to give better advice than random people on the internet.
