Hello,

I am a green card holder who is planning on applying for US Citizenship next year. I have plans to marry an F1 student this fall. These are my questions and any information or direction to information is appreciated.

1) When I apply for US Citizenship, would this marriage cause a problem? Can they deny my USC application based on my marriage to a non-immigrant visa holder? N-400 application form specifically asks questions about your spouse and her legal status.

2) Should we get married in US? If we get married back in my country, would that cause a problem for my USC application and her green card or K3 application following my USC approval.

3) If we get married in US, would my F1 spouse be able to continue her school? If she needs an I-20 extension, would she have any difficulty because of her marriage to a perm. resident

Thanks for your time

Marriage will have no impact on your N-400 case, and as such, you can get married wherever you want. The only problem I could foresee with marrying abroad is that your new wife may have difficulty reentering the US on an F1 visa as there will be a clear immigrant intent.

3) If we get married in US, would my F1 spouse be able to continue her school? If she needs an I-20 extension, would she have any difficulty because of her marriage to a perm. resident

Sorry, don't know the answer to that question.

Thanks for the answer. It sounds like getting married in US or abroad with an F1 holder should not affect my N-400 application. However it may cause problems for her since it will violate her non-immigrant status.
