Hello,

I am a us citizen and i would like to bring my parents and my 17 years old brother on green card. he is the only one living with my parents now as my sister got married 5 years ago and my other brother lives in another country. I just want to see if i can get any help from you guys to guide me through the steps and is it possible to apply for my brother under my parents or what should i do?

i really approciate if you explain step by step including forms i need to file.

thank you.

Your brother is not a derivative beneficiary of a petition for a parent. They cannot immigrate together. And, no. there is no workaround to get them here together. Once he has demonstrated immigrant intent, he does not qualify for B2 F1, or J1 visas.

You must file separately. He has a long wait but can be married and his wife and children accompany him when his priority date is current. You parents can also file for him once they get their green cards. The wait is likely shorter but he must remain unmarried or have the petition voided.

If your brother cannot remain in your home country alone, you should file for him and once his priority date is nearly current then file for your parents. That is a way that they will be able to move together.

Read the USCIS website on family based immigration. The process is too complex to walk you through on this forum. If you cannot figure it out after reading the information, get an attorney to assist you.
