Green card for parent (IR5) at US Consulate Mumbai

Folks:

I am a US citizen sponsoring my mother for Greencard through US Consulate in Mumbai. National Visa center has already completed her case and forwarded to US Consulate in Mumbai. I have a few questions:

1) US Consulate Mumbai says all applicant should have an I-864 from sponsor. But I have already filed that with NVC on her behalf. Is that sufficient or does she need a separate I-864 at the time of her interview

2) Police certificate - where to get it from? Passport office?

3) Medical exam - does she have to wait for the appointment letter from US Consulate to go for the medical exam? How long does it take to get the reports? Is it a 1-day process? If so, can she do it at the same time as her interview (she lives far from Mumbai and would like to avoid repeat visits to Mumbai).

4) Finger printing - when does this happen? Same time as the interview?

5) Tax documents - US Consulate Mumbai page says the applicant should bring tax documents for the last 3 years. Whose tax documents -- the petitioners (myself) or the beneficiary (my mother).

Any information you guys can provide would be great help. Ideally I would like to talk to someone who has been through a similar situation.

how long?

Can you tell me how long the application process has taken to date? I also just recently applied for a green card for my mom though it seems you are far ahead in the process. Thanks.
 
I-130 processing time

RTK:

I applied the immigration petition (I-130) on my mother's behalf in Jan'04. Rougly speaking it took 9 months. I was going through the Vermont Service Center.

thanks PJ. so how much longer now that your case is approved and sent to Mumbai consulate? did you get an interview date for her? i have also applied to Vermont. thanks a ton for all the information.
 
Dear Peejay,

Can you list the dates starting from your filing of I-130 .

I have filed I-130 for my Parents and priority date on receipt is Nov-22-04 , Can you list time lines for each events like.

1> Priority Date:
2> NVC notification:
3> Date your files got moved to Indian Ebbassy:
4> Dates your Parents received DSL papers:
5> Dates your parents got interviewed:
etc..

Your input will be highly appriciated by people filing applications for their parents.

Unfortunately, I don't have exact dates, but here are rough estimates

1> Priority Date: Jan 2004 (1st week)
2> NVC notification:
3> Date your files got moved to Indian Ebbassy: Sep 2004 (second week)
4> Dates your Parents received DSL papers: Nov 2004 (last week)
5> Dates your parents got interviewed: Dec 2004 (last week)

From start to end the entire process took exactly 1 year.

I sent my parents a new one, FEDEX-ed it to them. It is pretty easy to preprare and I would not take a chance with the consulate people, at least in Jakarta.

My parents got them from the the Main Police Office in Jakarta, we used to be able to get that letter from our police local station. I am not sure how it is in India. Have that translated, just in case.

3) Medical exam - does she have to wait for the appointment letter from US Consulate to go for the medical exam? How long does it take to get the reports? Is it a 1-day process? If so, can she do it at the same time as her interview (she lives far from Mumbai and would like to avoid repeat visits to Mumbai).

In my parents' case, the consulate called them, after the got the documents from NVC, and asked them to go to one of the assigned hospitals. I can't recall how many days it took to get the reports, but I know it was longer than 1 day and done prior to the interview.

at port of entry, I think. My parents did not say anything about fingerprinting at the interview.

This would be yours. I FEDEX-ed them along with the I-864.

Any information you guys can provide would be great help. Ideally I would like to talk to someone who has been through a similar situation.

Thanks for your input , My File is with CSC(California Service Center) and they are processing OCT-04 files , so I am still one month away.

I was wondering how long does NVC(National Visa Center) takes to process the files once CSC completes their processing. Can you let me know when did your priority date became current , how long did it take for VSC to complete their processing before handing out your file to NVC , from that I can guess how long it will take for my parents.

Applicant in US or India ?

Hi Folks,

Have a basic question before I apply for my mother's GC.

Does she have to be in India or US when I apply for her GC? I see that interview, fingerprinting etc she has to go the cosulate in India but during the 9 mos to 1 year wait can she keep visiting US or she has to be outside US for all this time ?

You have 2 ways to apply for a GC for your mother:

1) Consular processing -- applicant in India
2) File I-130 & I-485 simultaneously -- applicant in US

It sounds like you are going the CP way. If so, I would highly recommend she not visit US during the period. I am assuming she would be visiting on a B1/B2 visa. If you have applied for a GC, it contradicts the intent of a B1/B2 non-immigrant visa. When you get a B1/B2 visa, you explicitly claim that the intent is not to immigrate. If the immigration officer finds out about it, she may be denied entry into the US and cause further complications. I would recommend she stay in India during the GC process... usually takes about 1-year.
 
My I-130 got approved by USCIS . Priority Date : Nov-15-04

I would like to know when do we need to send the Affidavite of support (Sponsor) , Do we get a notification from NVC that we need to send Sponsor letters to the relative in India ? or is there any other form we need to start filling up while NVC forwards case to indian embassy?

Visa Fees

PJ or others:

My wife has filed for her parents (Nov 3, 2003) and we just got the AOS in Dec 2004. Her parents also received a DS-3032 form, which they mailed it back in Nov 2004 and now have received a letter stating that they need to send a Visa Fee to the NVC.

Is this a new process where the Visa fees and AOS are collected before the interview? How long does it take to get an interview after you have sent the Visa Fees to NVC? Are there any other forms other than DSL, they will require to send back?

GC interview for parents

My parents Visa date is next week ,I have filled I-864 forms and I just came to know from a agent in India that I have to fill I-864A also.

My understanding when I talked to USCIS Customer service here in USA was that I-864A is required when I use my spouse or any other house hold member's income for sponsoring my parents , because I am not using anyone's income except my income , I didnt fill-up the form I-864A.

Now I am worried and confused , can anyone please let me know if I require to sent I-864A even if I am not using my wife's or any other person's income to sponsor my parents? I have already sent I-864 but not I-864A.

Also let me know if I-864A is required and my parents dont get I-864A on time before interview date what are the implications.

If you are the sponsor and are using only your income to meet the requirements, you only need to fill the I-864. Pls have your agent read the instructions on I-864/I-864A.
