Hi guys,

Spoke with an IIO and was told that my I-485 has been denied. The IIO said that a possible reason for it could be that my file was, in error, sent for Consular Processing.

The case was denied on Feb 18, 2001 but they will be issuing the written denial only in mid July. My lawyer says that there is nothing we can do till the denial letter reaches him.

I have been laid off for a while but have an offer now. Unfortunately, my EAD runs out in the end of June, and even though I have sent for a renewal some time ago, with the I-485 denial, I guess the EAD is not going to come through.

A few things that I need your help on:
1. The best lawyer you know. Also, can the lawyer do anything BEFORE the denial letter is sent?
2. If the denial is because of a mistake made by INS, is there anything that I could request them to do?
3. Even if the EAD runs out, is it OK for my wife to continue working. It is tough to survive without an income.
4. Any suggestions??? I would love to be able to take the job offered.

Can u give ur details like EB Category, RD, ND, etc.

Do u have any clue on why ur 485 could have been denied (like 140 approved in wrong category, 485 filed at wrong Service center , etc. )

Sorry to hear the harsh news!

From what I know, I think the EAD validation will stand terminated from the date of your 485
denial notice. It would be the same case for your wife\'s EAD, if she has applied as a dependent
on you. It is better to check with your attorney.

One of the options you have is to revert back to H1 ( i.e. if you still have your 6 yrs cap open)
and in the mean while follow up with your attorneys on the cause for the denial notice and try
reapplying if it is for some problem at INS or providing the additional supporting documents.
( I think it would be too early even to guess before knowing what the reason for denial is.).

Can you please post your ND and EB category. Do you have any clue on what might have
been wrong? Did you find any anything different from others in the way the your application
was processed? Did you receive any RFE before ( in any stage labor, 140 or 485 stage).

Sorry to hear that!

Here is my guess and experience:

As your EAD renewal & I-485 has different notice numbers, there is a chance that you can get your EAD renewed.

I knew a case of denial of 485. He called IIO at VSC & came to know that it\'s a mistake by INS while checking the Finger Printing at the time of Approval.

Again the process took 6 months & got his GC. Yours also might be
similar.
