Green Card & Canadian Citizenship

I have Canadian Citizenship and US Green Card and I am
working in US now. I will get married in several
months and my spouse couldn't enter US without a visa.
I like my spouse to join me in a short period. As I
know, it takes several years for a green card hold to
sponsor his spouse for immigrant visa, and it isn't
guaranteed that she could get non-immigration visa.
Can I work in US using a TN visa - since I have
Canadian citizenship- and in this case she is eligible
for TD visa. Or are there other options that we could
use.

Spouse doesn't have Canadian Citizenship or residency

Your input is appreciated.

NO NO NO
You don't want to do a TN visa now that you have a Green Card.
You would null and void the Green Card. That visa is specifically to work with no immigration intent.

When do you become eligible to file for US citizenship? I think a better alternate would be to get her into Canada and get her Canadian citizenship ASAP. Then she can join you on TN. While all this is going on, you can simultanously apply for her AOS in the US.

To get her Canadian residency through marriage, I think he needs to reside in Canada to sponsor her. If he resides in the US, then he can't claim he also resides in Canada. If he claims he resides in Canada, he'll lose his US green card.

Best thing, is she enters the US as a tourist, then he files I-130, and I-485, EAD, and Advance Parole. She won't be able to work until the the EAD is approved, and she won't be able to travel until she gets the AP, but then again, she would not be able to work on the original poster's idea which was to get her TD status.

At least you'll be together, which seems to be your main goal.

Thanks all for your input, it is helpful.

It seems GC hold has very restricted options. I didn't imagine that until I started investigating it. Does the student visa work the same as tourist visa? because chances to get Student visa is more.

Hi,

I am in the same boat like you .I need clarification please .I have limited knowledge in this subject

How about F1 or student visa here , can we still do the EAD and I485 ??

So whats the V visa that most immigrants want back .Is that only for cases when she can not come in to US with any kind of visa B1/F1/H1??

one last Q please .If she is entering USA to study for 2 weeks /month , will she still be able to do this? any restrictions?

Any inputs please will be greatly appreciated
