Green card by birth or citizenship ?

Hi All,

I am Pradeep. I was born in India during the ethnic riots in Srilanka. However my dad had opted for a Srilankan citizenship although i was born in India. So i hold a srilankan citizenship and i have graduated in india all my life with proper visa's to stay and study in india.

I want to know if i apply for a green card, would i qualify as a Srilankan citizen or Indian ? Would they consider my birth or citizenship ? My birth in india was just accidental due to the riots break up in srilanka in 1983. Can anyone please confirm if i submit my application for the Green Card, will i be put in the queue for indians or srilankans ? Cos im sure the srilankan queue for green card will be much quicker than the indian queue. If they consider my birth place, is there a way i could fight out with the US Embassy with proper evidence of my srilankan citizenship ?

If i qualify as a srilankan, then i would like to know how quickly would i get my I-140 ? What is the current wait time period for a srilankan for the i-140?

I appreciate any suggestions/replies to this question.

Country of birth decides your eligibility in the employment based (and eligibility for diversity green card as well) card quota system, not your citizenship. You unfortunately will be considered under the quota for India.
