My husband was granted political asylum last year, so we can file i485 this april, but my husband got caught shoplifting and has pending criminal case now, this is his first time and value is less than $100, his lawyer said he may still can file i485, because he qualify for the petty offence, but my husband worried it is too danger to file with a pending criminal charge, so he wanted me to file first, in that way at least i can get the green card, but the lawyer said it's not right for me to file first, because my green card application is depend on my husband's asylum, i maybe got denied if i file first. I don't know if this is true, should I need to find another lawyer to file for me.
