green Card and Vistors Visa

Hello All

I am on a vistors Visa Right now, My i94 Expires on 18th April 06, Lets say I applied in the next week I485 and i130 as I have married a US Ciitizen, Does that mean I would have to leave the US on 18th April?

Or does the application allow me to stay till my GC gets approved?

You will be able to stay until the decision is made (approval or denial). Apply for Advance Parole and Work permit since you are on the Visitor's visa...

My colleague married Canadian (she is American) few year ago. They did not get the fiance visa, the guy just came from Canada with drivers license and got married. Kids, life, eventually the paper issue came up. They tried to file themselves. Filled out I-485( no I-130 what so ever), marked "other", did some other weird things. Paid the fee, waisted time, visited even INS office. They got rejected.
Other people are careful, fill in the forms, read forums, consult with other people, call USCIS if have any doubts on how to do it. And they do just fine. It depends on your finances, on your will to pay the lawyer fees(which are pretty high considering all you need is few forms and lots of time). Also it depends on your situation. You will have the interview, you will be asked to prove your marriage is real. You will be asked of your intentions before you came to USA . And so on... So you will have to decide... Good luck!
