Green Card and Employment in India

Hello,

Me and my husband got GC in sept 2000. My husband is taking up a job in India and we are planning to leave US in May 04.

We are thinking of visiting US for 1 week in Oct(before 6 months) and then I will come back in April(again within 6 months) and stay here with my sis in law for 3 months and apply for citizenship in July 05.

I have few questions:

1. Do I have to be employed while applying thru approval?

2.These breaks of 5 months each in 03-04 calender year look like break/abandoning residency thus rejecting the application?

After getting GC I have stayed out of US only one time for about 6 weeks. So 30 months in country is valid.

3. Can I only apply even though I came here on H4 and got my GC thru my husbands employment . So does my husband apply too wit me?

My GC says I am resident since 97 oct which is not true, which we tried to correct twice by filing I-90, each time they sent a different brand new card but with the sme wrong info. I have the letters to prove that I tried to correct it. Will this creare a problem when applying for citizenship.

Finally, 2 years back I got 3 tickets. While reversing out of parking lot, I rear ended a car and because of personal circumstances(2 week old newborn was crying non stop), and it was snowing, so I didn't keep a note outside the car but came home and was going to put a note in plastic bag and put it on the car. All this happened outside my apartment complex. But by then someone else had called cops and cop was at the door. The police report says she didnt have the time to attend because she had to take care of her baby.

I was given 3 tickets:

Leaving the scene of accident, Not reporting to police, careless driving.

I contacted a lawyer and entered a plea bargain and paid all fees. And that was that. I have no other ticket none what so ever.

4. Will this affect my application in any way?

5.Even though I don't need reentry permit, since I am going to come back with 6 months period each time, Should we apply for reentry permit, just in case? Or does that imply that we didn't actually intended to stay out of the country for more than a year thus giving them a suspicion.

The wait and mental hardship was so bad to get the GC, I just don't want to give up the GC.

Any other suggestions?
