Great Article in Business 2.0 (Not immi. related)

Today I read this article in Business 2.0
-----------------------------------------------------------------------
The Coming Job Boom
Forget those grim unemployment numbers. Demographic forces are about to put a squeeze on the labor supply that will make it feel like 1999 all over again.
-----------------------------------------------------------------------

The article talks about how skilled labor is in high demand and IT folks will continue to command increasing salaries till 2010. It also talks about jobs going to India as miniscule in size (14Billion in India compared to 813 Billion here in US).

Read this and you will feel great. It talks about high skilled IT jobs as being in demand for the next decade.

I think the article was discussed earlier

Also please be careful when you cut paste from commercial websites. People are cracking down on copyright issues.
I know of some cases where students were issued severe warnings by some publishing companies.

Hi patienceGC,

Instead of cut and paste of the text itself , if we paste the URL (Link to the article), will we still voilate any copyrights ?

Thanks

Re: I think the article was discussed earlier

Good point. Will remove it soon. I did not find any active copyright notice associated with this article but most articles of such nature are copyrighted making one responsible for determining that such material is not protected by copyright, trademark or other proprietary right.

However this copy of Businesss 2.0 is available freely.

Also does copyrights change from company/website to company/website or does it change from country to country ?

What is the jurisdiction ?

For example If someone in US cuts and pastes an article from a website in India and posts in on a website in UK ?

what are the penalities ?

I believe cutting and pasting might be ok as long as you specify the source and give them due credit. If the purpose of cutting and pasting is for discussing such an article, I think it comes under "fair use" which doesn't violate copyright and other laws.

My own opinion ...

Palani, I think, 'Fair use' only occurs in educational systems (in classrooms etc.). The only book to be written on this subject was by my professor, when i was going to business school. In this case it might not be a issue since this magazine is available freely, but who knows????? after napster the whole rule changed.

I remember reading pasting text link is fine

Is posting these articles free advertisement for these websites ? why would a website take action since the articles are already available free of cost for the users ?

Asserting juridiction over foreign entities is governed by 'Comity'i.e., "the courts of one country will extend the privileges of courtesy and deference to the judgements and private rights accorded to the person under the laws of foreign countries"
An example of this was the "I love you" virus that caused a loss of 7 billion worldwide . It was caused by a person in Philippines but he could not be charged or extradited since his country did not have these cyberlaws in place when the crime was committed.

A tricky issue indeed.

Do you think those big companies will spend money and time on small players like us to start any action against us? We are talking about a non-issue here.

Pingpong,

Read this link http://www.templetons.com/brad/copymyths.html . It specifically answers your question. It says that it is up to the originator of the information (structure actually) to decide whether he/she wants fre advertisement.

Sai,

Point# 4 discusses fair use and it comes close to our situation here. But, still, it remains hazy. I think the website "www.bharat-rakshak.com" ran into some issues like this. Because, they used to post defence articles that appeared in other magazines/newspapers, in bharat-rakshak's News section. But, of late, they have stepped back from that and are now just posting links to the original articles. It sucks from a reader's perspective but sure does cover their butts.

If the volume generated by the small players is big then they might, just like RIAA is going after individual sharers of music.

Aha! just rememebered my professors famous words.

One can copy and publish something, to criticize it. Then it comes under the freedom of speech right, that overtakes anything.

Its very easy to find copyright violations these days. There are many techniques. My profs use it all the time.

The "cease and desist" notice is very common.

Pasting a link is not a violation but cut-paste is a violation. Thats why CNN has a link but not the whole article.

If a person cuts and pastes text and post on a forum , who is voilating the copyrights ?

The person who posted or the website where the person posted or both ?

Are there any privacy issues invovled in disclosing the identity of the posters to the owners of the copyrights by the website where the text is posted ?
