US Immigration officer denied me work USA Work visa because work is not performed in US soil. But with denial of USA Work visa, I entered another country A and worked for US company in Country A. Got back from Country A, then went and got US Work Visa as I am going to be working in the US Soil. But with this visa I went back to Country A to work for US Company.
This denial for USA Work Visa was due to not on USA soil. This info is still in the US Custom Immigration computer. Every time when I across US border they quiz me as if I have worked in any other country other than USA. Trying to catch me working in US Work Visa without being on US Soil.
My answer is always flat out BIG NO and I was just visiting. Passport has visiting visa from Country A. Then this leads the officer to ask me another question like "so tell me what places have you visited in Country A?"
In anyway can US Custom track me down with inconsistency in my stories?
1) Like US background check and FBI Check doesn't provide any actual physical presence during the stated time frame on USA Work Visa? (Does normal background check and FBI check provide all the location where a particular individual has lived in USA?)
2) I have filed the tax return in California, USA for the work I have done for California based US Company which was done in Country A. Do they even ask for previous US Tax Return at DV Interview? (if they did then I can always mention I did remote work at my home country B. Would this get me in trouble?)
Work Visa is TN Visa.
