Got RFE..

Dont panic just as yet. Not all RFE's are bad news. The RFE''s mostly depends on the category. I had applied I-140 under NIW category (Self petition, CSC) and got an RFE after six months. My RFE stated that my evidences were not pursuasive enough to prove that my work was in National interest. They asked me to get testimonial letters from people I didnt know personally autheticating my work. Since I am working as a scientist in a university they asked me to get the latters preferably from National Institutes such as NIH, NCI, NIEHS, CDC etc. I got five letters from different sources and replied RFE myself answering every question which was posed and within three weeks of submitting my RFE I got my I-140 approval.

RFE still not received
Hi guys
Still I didn't receive my RFE which was sent on Sep 05 2003. (I changed my address recently and so it might take some time). Also my attorney moved from Boston to New York (same firm anyway) but still attends to my case from New York. Hopefully this week I will know about the RFE. I will post the RFE once I know about it.

I think getting an RFE is good now a days because the approval is accelerated. I submitted my w2's from 2001 and also 2 pay checks per year tilldate. My attorney also submitted the company financial papers. I think submitting the w2's help to prove the company's ability to pay.

Just answer the query and you should get it.
Just send your w2 papers and your companies tax papers and if possible a letter from your president or HR requesting approval as you are a valid employee and willing to have you for a long period.
mine was same query and got approved last year.

waiting desperately for approval now as EAD card dependant on that. HOpe its not a long wait as have offer.
Does anyoen know if we can get the i-EAD if an RFE had been issued and replied to. Or do we have to wait for 90 days again.

I don't think you can get an i-EAD with an RFE. I got an RFE on my I 140. I replied and it got approved too. My EAD was approved also. My wife had to go to India for a vacation and we went to Boston INS to apply for her AP. The officer there denied to issue one - the reason he said was "Because of the RFE they are approving one by one. I am not authorized to adjudicate it."
