Hello All-

Got my PW from PA DOL.The position offered was for $70,300.Wondering what should my next steps from now onwards be and how long would it take to actually file ETA 9089.

FYI: my attorney sent the PW request 2 weeks ago.

The position is Sr. S/W Eng. - system software; Exp. needed is MS + 0 or BS + 5 years.I'm worrying that the offered wage is a bit too high!!

Next step

Your next step shuld be to file a 30 day job order with SWA and initiate the rest of the recruitment process. From the date your 30 day job order and all other recruitment is done, you have to wait at least 30 days before filing PERM. So, if you file the job order today, you can file PERM in 60 days, at the earliest.
 
Offered wage

Hi,
I am a little confused by this post.

In the first post it is mentioned: "...The position offered was for $70,300..."
On the third post it is mentioned: " ...I'm worrying that the offered wage is a bit too high!!..."

From this I understand that your wages does not meet the PWD from the PA SWA which the SWA says is = $70,300.

Isn't it true that there will be a denial if the applicant's wages are < 100% of PWD ?

A related question:
Is there a point in going thru the recruitment process - as bjorn as suggested - if the wages are < 100 % of PWD?

On the good side, it seems that the PA SWA is quite efficient, since it took only 2 weeks. Wow!

The PW for the job is what it is according to the SWA, regardless of EB. You can look on the Internet for the official PWD source used by the SWA and see what the official PW is for any job in any state. That way, you may be aboe to work with your employer to come up with a different job title in order to meet the PW if the current PW is higher than what your offer is. If your wage offer is not at least 100% of the SWA PWD, there is no point of moving forward with PERM as DOL will automatically deny any application with a wage offer less than 100% of the SWA PW.

H1B-GC - can you tell me what "wage level" the SWA gave you for your job - sr software engineer with MS + 0exp or BS + 5 exp?

well i agree with u but also he is allowed to go for an alternate prevailing wage. like a private survey or so that is the closest to his current wage. this is my advice, look online for altenrate wage data for such position. usally they r lower than what dol specifies.what do u think guys?
 
It's Wage level 3!!

I have no idea about the EB level.i guess its a long way out there till something substantial happens if ever.

I guess My attorney had sent by mail but not sure.
