GOT Medical RFE! Urgent Help needed!

Hey You guys, finally the lawyer informed me that they got the RFE. It's for the medical records only! They want the originals apparently the doctor submitted the copies. (The lawyer couldn't veirfy as they are not allowed to open the doctor's letter)Bullshit!!!

Anyways, just to rectify the situation here's my question?

Do i get the new medicals taken, because i have moved and i am in Charleston, SC vs the doctor is in Atlanta, GA. This was done 2 years back.

Would it harm if i get new medicals taken?

the doc should have given one copy or original to you.

y don't u check if your copy is original and send it to vsc?

BTW, has you online updated the RFE info?

thanks for the reply. I don't have the originals for the medical records. i might all the doctor and see if they can send to me.

Yes, according to immigration officer RFE was generated on March 11th, but then it got mailed out on April 2nd. And the online message was updated on April 2nd itself. Today April 7th, i got the unlucky news, becuase of which the case is delayed again.

It is true that medicals are supposed to be only opened by the Immigration people so your lawyer is right.

I think you just should call your doctor and explain him the situation and he should have all the records. Even if he does not have the originals with him he can make a certified copy for you(He might charge you for that).

Taking new medicals is no harm but a waste of time and money.
 
I got the similar FRE last year. Check with the Doctor and try to get the original one ¡_.

The only risk i'll be taking is doctor's words against my papers. What's the gaurantee that this time the doctor will put originals?

For sure we can't open the originals!!

You are right the new ones are waste of time and money?

Were you guys able to get the originals and did not face any problems?
 
Get a new one done

I had medical rfe but i live in a different state than the one where i did the medicals before. people have varying views but i read on murthy forum that medicals need to be done in the state where you reside (check their chat logs).
hence now i did it in my state making doubly sure that the doctor was signing everything and then verified by his nurse if the doctor has sealed them himself and signed it.
If I were you, i would rather do it in my hometown rather than depending on some out of state doc (and hence no control over the specifics etc). also it has been two years now so why not get a fresh one done and not leave anything to chance.

thanks dude! I am going in for the new ones. I just got the fax from the lawyer and it only states to submit originals forms. You have made valid points about the state. Plus you can veirfy and stuff and that way we are sure that originals are turned in.

It's just got to be another few buck and i'll have to get the HIV test done again. Bummer!

I recently received a similar RFE for medicals. The idea that a photocopy was mailed to CIS may not be true. The reason that was given for mine was that it was not signed by the doctor, wish was not true because I had the carbon copy of the medicals and it was signed. Plus I was standing there when the doctor put the orginal in the envelop and signed it.

My guess is that b/c I have the antibodies for TB, it is recommended that chest x-rays be done at least once a year (old medical policy, especially if the individual does not know in some countries TB vaccine is given as part of the immunization), and since my medical was older than 15 months that triggered my RFE in December.

I recommend that you re-do it again, like I did when I received the RFE. I scheduled an appointment as soon as the lawyer alerted me to this and within a week the CIS had it my response. It may seem as a waste of money but you may be able to work it through your PPO or HMO as a yearly medical examination..

I disagree with this because I checked with USCIS customer service about medicals. They said, Doctor has to be INS recognised. There is no problem from which state. I was in PR at that time when i sent in my application and I got my medicals done in PR.

what you said makes sense. Because i am going over the I-693 form and everything seems to be fine. The doctor even signed it. Most of the remarks are handwritten by the doctor. They even did the chest x-ray. The date the exams were done were 12-3-01.

Since USCIS agreed to adjucate case even though the medicals were old, they are finding other reasons to delay our cases. There backlog is causing the medical reports to get old.

I am just going to get new ones done. You are right, i'll probably will have to pay for lab fees etc!!! Most likely my insurance will cover this as a yearly physical!

Like I had said the state thing may or may not be true. my lawyer said that you could do it in any state. the chats logs on murthy say otherwise. I am not too sure but did not want to take any chances since already 20+ months have been wasted coming to this state, then why take more chances for a few bucks.

My lawyer did not get RFE for my wife as yet?

Her online message reflects that RFE was issued on April 2nd. Could it be delayed in the mail?
