Hi,
I recently got my GC approved after using AC21 about a week ago.

Can I now quit my job now and go to school or simply be unemployed if I want to on my GC status without worrying about F1 visa or any such stuff, correct?
Pls advise.

I485 filed Jul 2007
Approved Apr 2008
Switched jobs in Feb 2008 and used AC21.

It depends on who you ask...

...and the more you read about it here or on other sites/forums, you will only get more confused.

There are people on both sides of the aisle who have had different results at the time of citizenship interview.

Just recently somebody swore that they left the GC employer after a very short time of getting GC, and was not questioned about it at the time of interview. I personally know ppl who quit a couple of days after receiving their GCs and are now getting ready to apply for the citizenship.

In this age of AC21, I personally don't think you are bound to the sponsoring employer the same way as before but ppl have different levels of comfort with the issue. I also moved on after a few months with my employer.

Going to school full-time makes sense and should not hurt your chances of naturalization when the time comes, as one can argue that one needed to augment one's skills to remain competitive in the job market, etc.

Good luck!

You certainly don't need an F1 visa, as the GC will allow you to work or study anywhere you want. However, leaving shortly after the GC puts you in a legal gray area and could cause trouble at the time of applying for citizenship. Some have been hassled in the citizenship interview about leaving too soon, others didn't get questioned about their employment at all despite leaving within a month or two after GC approval. It boils down to how comfortable you are with rolling the dice, and how important US citizenship is to you.

Hi,
In fact with this new found freedom I wonder if my following dream ideas are possible?

- Seriously if I would like so, can I not do anything and continue to live in US. I really mean, not do anything. I am an artistically inclined person and want to be for some time without any work (kind of like sabvbatical)? Can I do that?
- Can I do totally different jobs (like bartending, waiter etc). My GC was approved in EB2 (engineering category).
- be in and out of college for different programs as I please.

Could someone tell me if any of these things will cause problem during US citizenship after 5 years? Thanks.

You can do any of those things with your GC, but since your green card was employment based, you run the risk of problems if you jump into those things too soon after GC approval. How soon is too soon? The most common opinion attorneys is 6 months, but nobody knows for sure and nobody will know until there is a court case or USCIS memo or legislation.

Welcome Notices Received!!

Hello Jackolantern,

How are you you doing? I remember you from last summer. Are you with the same employer? It is nice of you to be still around here to guide and help the immigrant community.

I am happy to inform you that I received the 'Card Production Ordered' e-mails and LUDs in the early hours of May 13, 2008 for me and my family (going by your record [Card Production Ordered - July 13, 2007 and Cards Received - July 20, 2007], I am hoping we will receive our cards next week).

There were further LUDs on all four I-485s yesterday (May 16, 2008) and we received the 'Approval Notice Sent' e-mails also.

We also received the 'Welcome Notices' in the mail yesterday (May 16, 2008). The 'Permanent Resident Cards' should arrive in the next few days.

I feel completely relieved after more than 7 years since I came here. I haven't visited home (India) so far, even though I had the AP. I am now planning to go home for a visit with the 'Permanent Resident Card' in my hand.

Actually, I resigned earlier this month. That makes approx. 10 months with the employer after GC approval, on top of 2 years with them while my I-485 was pending. I am not going to worry about it one bit unless I see a court case or regulation saying that isn't enough time, which is highly unlikely.
