I just got my notice today and was wondering if I should not wait for the scheduled date.

Does the 485 application change on AVM

When the FP notice is generated and mailed, does the 485 application status change on the AVM?. If yes what would be the message?
 
AVM, Online case status changed ;FP done today

The AVM/Online Case Status should change to something as shown below.

"we mailed a notice requesting that you appear for fingerprint recording. The notice also gave the times and location where this processing could be done. If 14 days have passed and you have not received this notice, you may wish to verify or update your address"

For the benefit of others

By the way I got my FP done today at ASC, San Francisco. It was very organized and got done in less than an hour for both me and my wife. My case details are

MD: 09/06
RD:09/10
FP Date Notified on -09/23
FD Date Scheduled for -10/23
Got FP done today 10/03


I was asked why I came in earlier and I told them that I had travel plans for the date that I was scheduled for. It didnt seem much of a problem going in earlier than scheduled.

labor subs

rambo,

i was reading thru 140 trackers and am planning to file 140 using a subs labor. i know you went thru this process. did u get any rfes. what docs do we need to send? did u exactly match the min req? did u send an edu eval?

Substitue labor

Hi Viks,

I got my 140 approved based on a labor substitue. I have filed 485 now and got my EAD and finger printing is pending... My substitute 140 was approved in abt 4 months from california with one RFE...



I got RFEs to prove the following:

1. that the person whose labor was being substitutesd is no longer with the company - proof of his resignation, payroll info, last paid salary etc.

Luckily my employer had all these in storage and pulled out those info. we gave a quarterly employment pay roll showing that the person was employed and the next quarter showing him off the pay rolls. plus the resignation letter ( print out of the email ) and some clearance letter offered to him on his resignation.

2. last two years financial info of the company - quarterly financials.

my company did pretty ok on financials.. profits declined but were steady. so it was clean


3. question abt any layoffs in the past si xmonths - in the company, in the same job title...

my company did not have any major lay offs.. so it was okay.


Other things to watch out for in a substitute labor case:

1. make sure u have all the qualification when the originial labor was approved ( not when u apply for the substitute case) Foreg , if the labor asked for a min of three years work ex + Masters - u shd have them all when the original labor was filed ( which may have been a year back or earlier and not when u file for the 140 subsitute which may be now)...

2. I found that this is one of the main reasons for substitute cases getting rejected.. some attorneys may overlook this at times.. make sure with ur attorney too...

make sure ur qualification matches the orginial labor filing.

thanks a lot for writing so much, i really appreciate it...

i think my company has all docs related to the rfe info u talked about, resignation, financials are strong(profit) and also no layoffs at all...

i meet all the qualifications when the labor was filed, such as job desc, 4 yr bachelors and 5 yrs of exp eb2...

however i have a EE major and on the 750 it says comp sc major...i spoke to my attorney about it and after looking through my edu eval, it is attested that the way i took courses in school, i have a double major in EE plus a major in Comp Sc...

my attorney says this should probably sail it through...

i hope it does...let me know your comments and exp on this...

i look forward to meeting in 485...

I140 without RFE's

Vik,

In my case I did not get any RFE. My case was that of Labor substitution EB3. I got my approval in abt 4 months. I believe most RFE's are for company financials, work experience and education not matching the original labor cert, signed copy of labor required. These are the 3 most common ones that I have seen on this forum. Looks like my attorney did a good job of sending all the required documents. Also the labor was that of some time in 1997, so there was some speculation on the I140 forum that it takes time to pull out an old substituted labor cert from the INS warehouse or whereever it may be. So consider that aspect of it too. Good luck to you on your I140 petition.

Question for Mitwaa

I went through your response to an earlier mail, I thought I will share my information.

My case is also an EB3 Labor Substitution. I got an RFE calling for
detailed experience letters, with specific dates of joining and leaving. One more twist to the issue was,on the experience side,
I had 6 months less experience ( as on the date of filing ), than the person for whom the LC was originally obtained.

To overcome this we have taken some reference letters from some people, equating my old experience to the tasks that I currently perform and how they are relavant.

But I have a Masters degree, where as there was no education requirement listed in the LC. The job duties that I had on my past experience letters are also very much the same as those mentioned in the LC.

One more item the INS wanted, was a letter from the employer saying that an Immigrant petiton was not filed for the old employee.

I got the approval in about 14 days after they received our response for the RFE.

I am going for CP and my question and concern now is :
a) The job title as the company mentioned in their offer letter
to me is not the same as the job title in the LC. ( By the way
I am working for the same company which is sponsering my
GC ), though the duties are the same and the field is the same.

b) My salary is less by 10 grand from the one mentioned in the LC.

Will these two issues be a problem down the line, during the interview ?? I would like to hear if you have heard any experiences like this ??

Any thoughts please? The question simply put is " How important is your current job title and current salary when compared to the
information contained in the LC " .
