I Just got my Ead for one year while I still have an outstanding RFE meaning I havent replied to the ead as yet because im haveing a difficult time gettinmg the Infomation from bach home in my Country. I made an infopass this past weekend for today went in to my D O and walked out in about 2 hrs with my one year EAD no questions asked. My time line are as follows:

B2-Overstay married to USC
Mailed Date:Jan 13th 2006. I485,I765,I130
Recieved Date:Jan 15th 2006
Notice Date Jan 23rd 2006
March 1st 2006 RFE: I485
March 29th Recieve Biometrics Notice
April 20th Biometrics done

I thought you couldn't get an iEAD till after 90 days of receiving the info asked in the RFE. When I went to talk to them they told me their hands were tied till then...I guess they lied to me.

I dont know if they lied to you or that someone at My D O office didnt really do their Job to check but all I know is that I have the card in My hands

Maybe at some places you get it 60 days after responding? On the processing times site they say you can call the service number if you responded to an RFE 60 days ago without receiving a decision. Don't know if it has anything to do with getting an iEAD...

That is just weird I think. It all depends on the officer you get. I might try going again in a month if I haven't received my EAD yet. OR whenever it's been 90 days since my initial RD.

Maybe Bahamas124 did not have a note in the RFE noting that iEAD's are not allowed if one has an RFE.

I will try after 90 days as well; but I really hope I get an EAD before that!!!

You are eligible to get an iEAD 90 days from your RD. I believe that the RFE pauses the 90 days clock and resumes only after USCIS received the requested info. I have not heard of waiting 90 days from the RFE date to get the iEAD.

This is what is written in my RFE (among other things of course):
"You are ineligible for interim employment authorization pursuant to Title 8, Code of Federal Regulations, Section 103.2(b)(10)(ii) until ninety (90) days after the missing initial evidence is received."

Thanks for shedding light on that. This rule probably did not exist or was not strictly enforced last year.

Yup, that's the same thing I got. It might be some new thing.

See My RFE never said anything like that all it said was I had to respond within 87 days or my AOS application would be denied. so I still have untill may 27 to respond

That is SO weird, it's not as if you applied that much earlier than we all did.
