Got congressman's letter today: name check pending since 03/11/2003.

Got the congressman's letter today, thought it was good news, but really disappointed to find out that my name check has been pending since 3/11/03. This is something new, 'cos I was told NC pending since Sep 03.

Here is the message:
"... A review of FBI's Name Check Program database revealed that a request from USCIS on Mr. XXX was received on March 11, 2003, and is currently pending. Due to increased national security concerns, in December 2002 to mid January 2003, the USCIS submitted an additional 2.7 million name checks for processing to the FBI. Although 99.8% of these cases have been processed, the NNCP section is still clearing residuals for those priority cases. ..."

Congressman said he will do another inquiry for me in 60 days. The best those politicians can do is to make an inquiry for the status.

I am going to write letters with my FIOPA, notarized certificate of no-criminal records from my home country (maybe useless), inquiry result from congressman, and send them to Hardy and Hooton through certified mail. It couldn't do any harm, at least...
 
Which country are you from?

I have the similiar situation with you, I am from China. Which country are you from? What is your visa history? Let us see if we have something in common.

From China also

Hi, Tireofwaiting, I am from China also. I came as F1, changed to H1 and worked for 2 years, then changed back to F1 for a 2nd Master degree, then to H1 again till now.

Been here nearly 10 years, clean records both in home country and here.

Only things that might be a problem are:
1. worked for a bio-chemical company (as IT professional though)
2. wire transfered $25K to parents in home country. Large amount (over 10K)international wire transfer might raise their concern.

Nothing else I can think of.

My story

Per name check--my security was pending since April 2003 or so--I understand how you feel. My advice:

1. Get at least two different congressmen or senators to send enquiries on your behalf--AND DO IT regularly. I have sent in requests for information every 30 days, month after month! If one office says they won't send anything in for 60 days, contact another senator!

2. Also, if the dates when USCIS is processing cases are AFTER your ND, then you can make additional enquiries through your congressmen or through USCIS. THAT DATE is important--you will at least allowed to be heard!

3. ASK your congressman or senators' aides to CONTACT THEIR FBI LIASON officer for information on WHY your case is still pending clearance. Usually they only contact their HS-USCIS liason officer--but if your case is stuck in name check, you can request information from their FBI liason officer.

4. Also, in your letters to the congressman or senator's aides, mention your worth. Mention if you have a house, pay regular taxes, have no criminal background (IF THAT IS TRUE--NEVER, EVER LIE TO ANYONE)...etc. Those details may never go back to the USCIS or FBI officers, but you need the good will of the congressman's aide so that he or she is sympathetic and is willing to make enquiries on that matter--that is, they see you as a human being, and not just another number. If you can, TALK with the aide--so that, again, he or she can hear that you are an upstanding citizen. These aides get thousands of requests for help everyday--you want to be able to stand out. At the end of the day, people who work for the government really care about the people in their area--especially those who contribute to the area. When talking or writing--be polite, but also be confident and assertive (don't be arrogant or rude). Don't be a sycophant--just be very assertive, BUT POLITE!

5. Other than that: Wait. Learn to be patient.

My thoughts are with you all. I am still waiting....waiting...waiting :( but thought I'd share what I have been doing.
 
Is this related to FBI Name Check. Please Advise...


My NIW based 140 was approved in 2002. And my 485 has been pending since 8/2002.

My wife and I each called National Customer Service center last month. They filed an inquiry for each of us. My wife got a finger print notice on which says "we won't send this notice to you unless your case is close to adjustment" -- which I read as a good sign.

The response to mine was "You case is currently undergoing the increased security check the U.S. Bureau of Citizenship and Immigration services has mandated for all cased filed at the Nebraska Service Center".

I called National service center again. After explained this scenario, the person transferred me to an immigration officer. The woman looked up on her computer and filed a "referral" number for me. She asked me to write down the referral number (could be reference number, I heard referral). And said NSC will call me within 30 to 60 days.

My question is:
Is this referral thing different from status inquiry?

Will NSC take quick action on receiving this thing?

I’d appreciate it if anyone can share similar experience

I got similar reply as you received. My 485 was filed on 8/2003, I made enquiry based on current processing date 11/2003. Yesterday received response form NSC as "Your case is currently undergoing the increased security checks the U.S. Bureau of Citizenship and Immigration services has mandated for all cased filed at the Nebraska Service Center".

Is this same as FBI Name check or something else. Do you know the status of of your name check. Please share your details.

fyi: My name also starts with same first three letters.

Wow, 100K to your parents! I got to admit you are a good son/daughter, you make me feel bad for just sent 25K. :)

I guess as long as the receiptent of the wire transfer is your parent(s), we should have nothing to worry about.
