Adjustment of Status for Asylees
By law, only 10,000 asylees can adjust status to Lawful Permanent Resident per year; however, the Service is receiving between 25,405√ 43,881 applications per year. As a result, as of January 10, 2005, approximately 186,170 asylee adjustment applications were pending. We anticipate that we will process pending applications according to the following schedule:

Help! 8 years of waiting for I-485 results

I applied form I-485 through my wife in June 1997. My wife and I went for the interview at the local INS office back in the summer of 2000 but we haven't heard from the INS since. Is it normal to have to wait for almost 8 years to adjust my status? My wife was still a permanent resident at the time when she applied for me and I am in deportation proceedings and I wonder if I could face deportation some day if we keep waiting. My wife became a citizen about 5 years ago, we have a son who was born in the USA but I still have no status in the country. My attorney says we should simply wait but it just doesn't seem right. If my wife applies again for me as an American citizen will it take less time or shell we keep waiting as my attorney recommends?

I think the wait time for this type of petition (spouse of green card holder) is currently 5 years, but was much shorter at the time you applied. I would definitely consult another lawyer; this one seems incompetent to me. I also think that some forum members discussed the possibilty of requesting case status from the INS, but I am not sure if it is feasable. I also suggest that you check the forum titled family-based green cards in this web page since this is an asylum forum. Good luck

Actually this new table shows some movement, especially for those who applied between 99 and mid 2002. Those who applied after that got the shaft. Please contact your senators/representatives and ask them to eliminate the 10, 000 yearly cap on asylee.

Why can't you update your existing I-485/I-130 applicaiton with the fact that your wife is now a US Citizen? This should change your timeline/timeframe for waiting for adjustment. It is definitely NOT normal to wait 8 years to adjust your status. It would not hurt to have your congressman/senator to get involved in your case. Your wife is a US Citizen and now commands their attention as a constituent.

I agree with the other poster - get yourself a new lawyer - the one you have is an idiot.
