Got a rejection letter for I-485, can s omeone explain why?

Hello,

I got a rejection notice from INS regarding my I-485. The NOA states, "...your priority date does not appear to be current... when your priority date is earlier than the correlating cut-off date listed in the current Visa bulltin, you will be eligible to submit again..."

Here are the facts:

My priority date is April 25, 2001.
The January priority date is April 22, 2001
The February date is May 01, 2001

I know that the Via Bulletin puts up new datesfor the next month on 15th of every current month.

After seeing the new February numbers on Jan 15th on the Visa Bulletin, I sent my application on Jan 16th. INS got and rejected my file on Jan 19th.

Based on these facts, is it possible that INS rejected my application because I sent my application on January and not February? It seems to be the logical answer.

I called INS, National Visa Center etc, but all I get is vague generalities and the runaround. If anyone on this forum knows the exact answer, and whether I should re-file on February, please let me know. I will check this forum every hour. Thank you.

Based on these facts, is it possible that INS rejected my application because I sent my application on January and not February?

Of course that is the case. Cut-off dates for February become effective on February 1 because they are for February, not for January.

Resend the packet after 1st feb 2007. They will accept it.
