Got a new job while passport expiring in 5 weeks

Hi,

I almost got a job, but my passport will expire in 5 weeks. I will be able to start to renew it in 2 weeks, but the renew takes 2 weeks as well. I wonder if I can use the copy of passport that is expiring in 3 weeks to apply H1B with premium processing?

Someone told me lots of INS document requiring passport not expiring in 6/3 months, and my H1B wil not even be approved. However, I think it might be possible that as long as your passport is valid at the time of approval and submission, it should be fine.

The relates to whether I should travel to New York right away and submit my passport renewal request in person to get the passport as soon as possible, or I can just submit it at a proper time and wait for the passport to come back, while using the copy of passport to get H1b approval if the job is offerred.

read I-129 carefully...

well... if you read i-129 it doesn't say anywhere about these 6/3 months, it just says that the passport should be valid, and it's valid until the expiration date...

I'm not saying you will be fine, I am just thinking aloud here... I won't dare to give advice and later get blamed. ;)

maybe apply for renewal and attach a notice that you have applied for renewal to the application packet?...

depends upon your home country embassy....

I heard.........
Indian embassy in chicago renews a passport same day if you go their personally. Most of the embassies does this if required by their citizen.
 
Due to some complication, my passport can't be renewed and it has to be replaced by a new passport, that's why it has to be done in person and it will take at least 2 weeks counting everything. I hope I could know from someone that has experience to know whether H1B application requires a passport that is valid in the coming 3/6 months in the past.

Passport can be renewed in same day

Go to any of the Indian Embassies and the passport can be renewed on the same day. Renewing means they will issue another passport with new number, stamp the old one as CANCELLED and you need to keep them both together like one while you travel. It does not matter if you already applied H1 transfer with current passport. I am not sure what any body does without worrying about keep the passport intact while staying abroad. My appologies if there were some issues really needed your attention than passport.

Hi, Thanks a lot to my indian friends. I am actually from mainland China and I'm looking to replace my passport in New York. It takes 5 business days.
