Got 221(G) at Chennai consulate.Also told that not to drop the passport at VFS office

Hi ,

I have attended US H1b visa interview at Chennai.

I got query and requested following documents from the petitioner for issuing Visa.

1)Petitioners income tax returns for the last two tax years and financial statements.

2)Notarized list of all the petitioner's employees of the job site listed.The list
should show all the employee names, there specific job titles, and their individual salaries, and immigration status.

3)State Unemployment wage reports for the past two quarters for state TEXAS.Including Salary information.

4)Interior and exterior photos of workplace.

5)Lease agreement of the petitioners premises.


Following are my observations/experience during visa interview:

I have shown W2 forms, financial tax returns(for the last five years) provided by employer to the Visa officer,But still he mentioned under item list 1 and 2.Could any body clarify whether tax returns and W2 forms mentioned above not suffice ?

They have not asked about photos during interview, but mentioned in the above list.

Visa officer mentioned also that need to attach following documents along with above documents:
I-797, I-129,Labor condition letter, DS-156, DS-157 and need to drop these doc's at VFS drop Box.Cleary mentioned that no need to come again for Visa interview at Chennai.

Also visa officer told that not to include Passport along with above documents.Could any body please clarify how visa would be issued with out passport?

Very sorry to hear that you faced issues at your visa interview in Chennai.

First step for you to do is contact your company attorney & your employer - explain them what went in your interview wrong & other details of your interview.

My assumption is that the Visa officer felt that your company might be a start-up or a small firm. I think the visa officer is concerned about the validity/existense of your firm, whether they would be able to maintain you by paying the right salary mentioned in your LCA etc...Some doubt had raised in the VO mind about your firm.

I think, if your company/attorney are willing enought to support you with the list of documents which the VO has requested, then it should go fine. Do not worry, be patient.

I assume the reason for not taking your passport, basically first to verify the validity of the documents that you would provide them & after verification they would surely request you over phone or email to provide the passport later.

Don't worry too much. Its a very difficult time, be patient and do your best. I am sure you would be back to US very soon.
