Good News On a Way for All EB Categories - Possible Visa Availability

Here is the good news for you all.

I received a email today from my Attorney ... body of the email as follows.

Due to recent encouraging legislation pertaining to visa availability -- particularly the passing of the Senate Reconciliation Bill this past Thursday -- we anticipate that the EB-3 priority date (currently at 1/1/1998) may move up significantly sometime soon, most likely around January 1, 2006. It is our goal to get your I-485 (Adjustment of Status) application filed as quickly and as efficiently as possible. Henceforth, we'd like to begin to prepare the I-485 documentation for you and other clients with priority dates before January 1, 2004. By doing so, if your priority date does in fact come current, most of the paperwork has been finished and we're not scrambling to get you filed.

Hi

Looks like your attorney wants to prepare papers for you so that he/she can charge you now for it. From immigration-law.com, the legislation needs to be debated by the senate and this would happen around februaury i.e. the bill may not become effective till mid next year. Also, even if the bill is passed no-one as yet knows how the extra visa's would be distributed.

I am not sure...

I thought the bill needs to be debated and approved further. Do you think perhaps your lawyer is getting too excited about it ?
 
Get back to the reality, man. DOS won't move cutoff dates forward based on the proposal. Firstly, it has to become a law.

I don't think it is true. No Attorney will send a letter like this. If he predicts the date can move to Jan 2006, why he takes care of clients only before Jan 2004? :confused:
 
My perception was that the attorney meant, "the cut-off dates will be moved most likely around Jan 2006". I don't think he/she tried to predict to when the cut-off dates would move though.

Very unusual... to believe that an attorney whose profession requires him to be politically correct has come up with this type of statement. It seems that there is something that more than meets the eyes/ears and mind from what has been posted either or what the lawyer has said... It is good to be positive but it is equally important to be realistic and for now, i am in the later stage.... :)

Just speculating

Please understand that we are not 100% positive that you will be eligible to file your I-485 right away, or even if you will be able to file any time soon. We are just speculating as to how things may happen, and we just want to be prepared if the priority dates do in fact become current.

They just asking to prepare documentation.
 
If they don't ask you to pay for this preparation immediately, I will be really surprised. I agree, that lawyers are having some spare time and trying to earn some money in the way like that.
