Great news! I talked to TSC IO again today, this time I literally waited to talk to someone for about 55 minutes. Finally a very well spoken gentleman answered and took my full name, address and eac#.

He put me on hold again and after 3 minutes came back online and said "Sir your case has been assigned to an officer and you should hear a decision within 30 days"

I asked him you know I am from a retrogressed category and said is this still good news to me that my case is assigned to an officer and he said "Oh yea definitely, you should get a decision in 30 days" and he also said the visa bulletin in December will see some movement. I am excited.

Hopefully all the long time waiters will get approvals by xmas

May be good news.. But I personally don't believe. On Sept 28th my attorney got call from TSC officer and she told him that everything looks good except visa number. Also, I got call from Congressman office on last friday, saying that your PD is not current that's the reason ur case is holding. When I called TSC IO samething.......no visa... for Indian nationals we r processing before Apl 22nd 2001 PD cases...

IO might be true on Dec bulletin.... I am also +ve on it..It may resemble Jun 2007 visa bulletin.

Lets hope for the best... Dec is very spl month for me as zinchak. I have met my wife first time and both my little ones are borned in Dec month. :D :)
 
Hurrrahhhhhhh Dec ;). Let's hope some movement in December frankly I am tired of waiting.

I don't the anything will happen in the next 30 days, I got a response from congressman wait for 45 - 60 days and I am sure that's a generic reply which they are giving to everyone.

Anyway all the best guys. Sometimes I just feel like going back enough of this.:mad::mad:

Maxwellhouse next time u talk to IO can you confirm if it is for all centers. Have you all seen the PR time for EB3 NSC today. I 140 EB3 has retrogressed. As of 15th Sept '07 it was 15th Nov 2006. As of 15 Oct '07 it is 14th Nov 2006. Is it a typo error or no applications in Skilled worker or Professionals is looked into.
Any inputs on this.

Looks like that IO didn't have a clue.
I m not sure why people keep calling uscis even when their dates are not
current and waste time.
Anyways.. good luck.
It's amusing how hopeful one gets when they receive these answers.
I am sure there won't be any huge improvement in situation in next month or so.

Your case is so much like my case. Another friend of mine, had exactly same dates as mine(no rfe though) and got approval in Sep. Lets hope we get our turn too.

yes im surprised too our cases are very similar and surprisingly even rfe of our both is similar. i have about 45 people from my company with my 2004 dates + or - month/two who got approved in sep07 for eb3 india, i personally knwo 7 people who got approved with almost same prioritydatss as mine for eb3 india.

i guess due to some screw up we both missed the boat in september, hopefully we will get it soon, so after u replied to ur rfe when did they exactly recieve ur rfe, pls post date? also post any luds on 485 after ur rfe was received by uscis, how many times did u do FP? pls post all exact details and it will be good to keep in touch

also when u got rfe, did u get only for tbskin test or for employment letter also? i also got rfe for tb skin test + employment letter? so did ur case status online change after ehy recived rfe? did it mention u will get wrriten decision or update in 60 days? please be more specific and post all details thanks

--One day to One Decade :p . no one will have answer for that.

--Only USCIS and God knows:eek: (I think the visa number allocated/requested when the time of approving the case)
 
I think Visa number is requested by the officer assigned, after he reviews the application and mark it to be approvable.
 
Joking aside, your answers may be right on. I believe being assigned to an officer may mean speedy processing, but only after NC is cleared. Otherwise it is still anybody's guess. Also service centers reps have been pretty vague as to what "assigned to an officer" exactly means.

Visa number is usually requested and allocated to a case when it is near being approved. But in special situations such as the July Visa Fiasco, a huge amount of visa numbers were requested by the CIS and it is fair to assume not all of them were approvable at that time.

I don't understand how your priority date is 2004 and you filed I-485 in 2004 too. Both you and maxwellhouse. You are EB3 and should have been in BEC for 2-3 years which means that you could've filed only this year for AOS.

Could you please explain?
 
This is where games were played in pre perm years. Some centers were fast and processed labor quickly. So these people got LC approval earlier. But many rotted in California and New Jersey and ended up in BEC which approved them last or this year.

So don't be surprised by anything you see in the World According to USCIS.

As seems to be the general concensus here, none of these officials have a clue! I talked to my congressman's office in August - and thats what they said then too - no visas available according to the bulletin. Call back in October.

I think December will be good for us all.

That's what am hearing from many friends attorney's. All expecting/hearing, There will be a very good forward movement for EB3 PD..especially for retro countries. Lot are guessing something like June 2007 Bulletin.

Priority dates were current till Jan 1st 2005 for all categories and for all countries. At the time the issue was getting Labor approval, but as someone mentioned, few state were lightning fast and some were slower than Turtle.

This was my third labor, the first 2 got stuck and then later one got withdrawn by company and and the other one rejected. :(
1st Labor Oct 2001 ( withdrawn in 2004 )
2nd Labor Sep 2002 ( Rejected in 2004 )
3rd Labor July 2004 ( So far going good... :D )

My 3rd labor was too fast, less than 4 month, and that gave me opportunity to file for AOS before Jan 2005.
