Going to school with spouse applying LC?

:confused: My husband just submitted his RIR EB2 LC to Pittsburgh SWA in November, 2004. I am not sure where it is now. I am planning to go to school in May, 2006 (I will apply in this fall) for a one-year master's degree in accounting. So I will graduate in May, 2007. However, because I have already used up my OPT and H-1B for a work I have been doing, I will need the EAD to be ready before I graduate in order to find a job. Do you think this is a realistic idea? By doing so, I am assuming that his LC will pass by, say, January 2007 (while it was submitted in November 2004). Am I taking too much risk? :confused: Should I wait one more year to decide? We are getting old though.

I used my OPT when I graduated with a Master's degree in Chemistry 6 years ago. I am currently working as an assistant in a professor's lab. But my H-1B will run out in May 2006. So I am thinking about doing a one-year master's degree in accounting staring in May 2006 till May 2007 in order to stay here with my husband who just submitted his LC to Pittsburgh SWA in November 2004. Do you think I will be able to get my Work Permit before I graduate in May 2007? If not, I will have to transfer to H-4 after May 2006 because I did not submit LC myself. Thanks! :confused:
 
Its hard to predict when will you receive EAD based on your husband GC application. BEC is planning to clear all backlog in 2 years. Also one need to apply I140 + I485 (provided its current for respective EB category) to get EAD.

About OPT, as far as I know, once you complete your second master in accounting, you should receive another OPT for 1 year, though I am not 100% sure on this. Please check with school immigration service or someone here can comment on their experiences.
