I have a 485 app pending at CSC. Need to go to canada and then form there go to India. Different airline from canada - toronto and then from toronto - india
where will the I-94 be taken. It cannot be taken out in sfo since I will be only going to canada.
Any suggestions will be useful
Thanks

if your trip is for more than 30 days, your i-94 is collected at sfo. however, assuming your trip is less than 30 days, your i-94 will be collected at toronto airport.

Usually they take the I-94 before getting on the plane for Canada. If they don't ask, go ahead and talk to one of the ground staff about it.

Normally it is your responsibility to turn in I-94 while leaving the country. If one doesn't turn in I-94 while leaving the country they may get into problems/delays while coming back.

If it is a short trip to Candada then one doesn't need to get a new I-94 so probably they won't trun in I-94 while leaving US. In your case you are sure you will go to India so turn in your I-94 at SFO before flying to Canada.

This was my expericnce before sep 11 event. I drove to canada. Before crossing US border there was no check -strange, on canada side they checked canada visa followed by a small interview and stamped port of entry on passport. While drivingback to US, canada stamped that I was leaving. US side there was no check except for drugs - so strange. I have lot of experience internationally, this didnt look normal. After I crossed the check point I parked my car, went into office and spoke to imm. officer. It was funny to find that there was no check.

If the same thing is happning, one doesnt need US visa to get into this country!! No wonder, what is his name who entered with chemical explosives (the case is still on trial) ahmad al... - cannt remember. Some times I see in the local TV news.

glxy,

i believe you were not asked for any documentation at poe because you had a valid visa and a valid i-94 when you entered the country.

about 5 months ago, i had been to toronto for a short trip (7 days). at sfo, i did not have to surrender my i-94. when returning, i had to pass through us immigration, where i produced my valid visa and valid i-94. no need to get a new i-94.

the act of walking into the imm office and showing documents (i have done same thing too) is the 'check'.

it is different - sure - but how many countries do you 'drive' into my friend?

US always checks for customs/drugs/visa at all entry points.

I crossed into Seattle from Vancouver by car very recently and it was exactly the same as what you described...

More over the I-94 is such a misunderstood document - just make sure you have ONE in your passport when you are in the US. You will ALWAYS get a new one when u enter the US, no matter how short your trip outside the US was.

I asked the Imm Officer at Vancouver POE (back from a 4 day canada trip in Oct 2003) the same thing (if a new I-94 is required). He said -- No, as long as the Canada trip is less than 30 days, your I-94 will not be taken NOR a new one given. I had filled out a new I-94 just to be sure (In all past trips to Canada, they had never taken the I-94 or given a new one). Since I entered on APD, he took a look at the APD, corrected the data mistake made by SFO immigration officer (wrote the wrong date on the APD where it is stamped) and waved me through.
