Hey guys, i need some help here. My wife wants a divorce and things are not going very well for me. She is a USC and I applied for GC in April 2002. we had our interview in september 2003 and i havnt got my GC yet because of FBI name check. Am i going to have problem if divorce occures before i get my card? If get approved which card i get the 2 year old or 10 years old one?

If you were married for less then two years at the time of your AOS interview then you will be given Conditional GC otherwise it will be permenant. I'm surprise to hear about your security name chekc. Mine was done in about a month. I guess i was prett lucky. The interviewing officer even show me the clearance paper afterwards.

Hey Tueman thanks. But waht about after getting a temporary one? How does that work?

Conditional GC is only valid for 2 years and at the end of your 2 years you will need to file together to remove condition on GC. INS will call you for another Interview to see if you are indeed living together. If you separate before then your GC will be denied.

Thank you very much Trueman for your information. Do you know when new law was in effect? If I had my interview before the law do you think I still get the temporary card? Or have you heard a situration like this before?
