I have an O-3 status which expires on January 19, 2007. My dad's O-1 extension will be probably get denied because he extended it 5 times already. I'm currently enrolled in two bachelor programs at NIU, so it would make sense for me to file an F-1 visa.
My two majors:
Computer Science
Operation Management & Information Systems
Financial Support:
Full tuition + housing scholarship for 4 years funded by Evans Scholars Foundation.
I entered U.S when I was 15, went to U.S high school as freshman, graduated with a 3.1 GPA.
All of my family is here: dad (O-1), mom (O-3), and brother (O-3, planning on filing F-1 as well).
My passport expired when I turned 16. We extended it through the embassy in NY for another 2 years, so now it's expired again and can't be extended anymore.
So based on all this info, what are my chances? How will not having an valid passport affect my F-1 petition?
My biggest concern is the non-immigrant intent. I know that people USCIS pays a lot more attention to people of ages between 18-37 with a single marital status. How would you go about proving my non-immigrant intent to prevent a 214(b) denial?
Would I remain legal if O-3 expired and I was petitioning F-1?
Can I continue my studies if O-3 expired and is pending at the same time as F-1 is pending, knowing that O-3 allows me to study?
