I got my H1 extension in Apr'05 and received I-797A (with I-94)..however for my wife I received I-797C only. While contacting lawyer, he did sent the I-797A for my wife; I never received it..might be lost during mail. My lawyer does have the copy of I-797A for my wife. I checked the USCIS website and it indicates that Case was approved.

I am going to initiate the process for obtaining duplicate I-797A; however I am not sure, if I would receive it before Oct'06. Hence I am exploring options.

I am planning for stamping(multiple entry) in Canada in Sep'06; We have to go to Canada before Oct'06 because our Canadian PR visa expires in OCt'06. Is it advisable to go for stamping with a copy of my wife's I-797A? is there any other alternative, if you don't have original I-797A?

Your help would relieve my stress a lot..
Thanks

for my H1b visa stamping in Toronto, passport, 797A and scotia bank receipt were collected at the first counter.
you might ask the consulate, nvars.com & your attorney whether an attorney-certified copy is acceptable in place of the original.
but you do not have to go for your visa stamping when visiting canada for your PR purposes; you can re-enter the US without problems if the visit is less than 30 days. This may not be an option for you depending on your nationality though.

not legal advice.

Dear tusharvk,

I really appreciate your reply.

I am an Indian.

I have my original I-797A with me but for my wife, I received onlyI-797C (without I-94) and never received I-797A (lawyer did receive, but seems lost in transit, lawyer has the copy of it)

I request you to clarify couple of doubts:

I understand that, if we both go to Canada for PR and comeback within 30 days to US, even if we have expired visas on passport, am I right?
While entering what are the documents required for reentering?

In case, if we also apply for reentry in one of the US consulate in Canada, with my original I-797A and my wife's I-797C and a attested copy of I-797A and if for some reason (e.g. not having original I-797A), my wife doesn't get the stamp, can she still come back? let me know, if my question is not clear

Appreciate your help..
