Giving up US citizenship.

I are a us citizen for the last several years. I would like to settle down in India and give up my US citizenship. If down the line I decide to come back to USA as my family members are all citizens what are the problems I could face. Will i have a problem getting a green card/US Citizenship again?.

If you are married then keep your spouse citizenship. Next if you want to come back to US, you can get GC in a month.

But Also consult a lawyer!

IF you give up US citizenship, then you'll have to apply for GC again. Better option is try OCI, if you want to reside in India for a few years and come back to US.

You would face the same problem as any other person would who applies for citizenship under the respective family relationship category. If your spouce retains the US Citizenship, it would be lot easier.

But as others have stated, why would you want to give up US Citizenship to move to India? Unless offcourse you want to fight an election and do *politics* there. Otherwise, you can get the Indian version of *dual citizenship* and happily work there - assuming offcourse you come from Indian background.

Other than running for office, I don't think anybody in india cares about our citizenship status, unless some new rules of ID are in place

Does anybody know how much time exactly takes to get GC/UCS on spouse UCS status? Any link to the tracking dates is greatly helpful!

Of course, if you were to apply for Naturalization again, you would be required to show an "attachment to the constitution". I'm thinking that giving up your US citizenship would count against you in that regards.

I have seen a case where it took close to a year.

delhi1,

As others have pointed out above, why do you want to give up your US citizenship while you have OCI and PIO options?

One reason I could imagine is not having to deal with the U.S. taxes.
According to the U.S. laws, if you are a U.S. citizen, then all your world-wide income (regardless of where you live or where the income is earned) must be reported on the U.S. income tax return and is subject to the U.S. income tax.

There may be some U.S.-India tax treaty provisions that reduced or eliminate the U.S. income tax liability, but it probably very much depends on the specific circumstances. In any event one would still have to file a U.S. income tax return annually and claim a tax treaty benefit there.

Also with OCI, if you really want to become an Indian citizen, you could do it after 5 years of residence in india.
Also i am not sure whether if you give up USC you would automatically become Indian Citizen (assuming you were before USC)

Also can you give up your USC while in US?
