Giving up GC to go back on H1?

Hello All,

I will appreciate your input to my question. I am a GC holder who is going to get married later this year. I have evaluated various options that I have in front of me (in order of preference):

1. Get married and bring spouse on her F1/H1 visa:
- Allows us to stay together
- Allows me to continue my work in USA
- Takes a long time for wife to get GC but we can stay together

2. Apply for wife's GC and stay with her outside USA (Canada, India):
- Wife's GC processing waits for the 4-5 years
- We stay and work outside USA and wait for her GC to come through
- I try to maintain my GC status (max of 4 years via re-entry permit, or enter every 6 months...basically very painful)

3. Give up my GC and get back on H1
- Allows both of us to come back
- Lot of uncertainty

My questions to the group are:

1. Has anyone in the group given up their GC and gone back on H1? If so please let me know. I would like to discuss the details with you
2. I am assuming that by the time I give up my GC and re-apply for H1, my H1 clock will be reset to a max of 6 years. Is that correct?

Thanks in advance for your answers.

Cheers!
Ashish

How much time do you have left to become a citizen? If you can spend that much time apart from your wife then that is a good idea too.
I have no clue about going back to H1. Sorry.

I will prefer option 1.

For option 3 you have to go out of US for 1 year to reset your clock.

If you are living in the US chances are your wife will not receive an F1 visa.
