I got my (company sponsored) I140 approved a few days ago (date of filing March 2003, CSC). I filed 485 concurrently (April 2003). From the BCIS site, I understand that my AP and EAD have been mailed.
I am as yet unmarried - my understanding is that to get my fiancee on the application, I should get married before my 485 is approved. Is that correct?
I am getting married sometime late this year (oct-dec), which is causing me big worries now.
I understand that I am done with if I dont get married before 485 is approved. I would like gurus here to venture and answer the following (I do understand that as with anything to do with BCIS, no one can make any guarantees, but some numbers/dates would help me frame some timeline)
- When should I expect my 485 to be approved? Its been a year since I filed it. (please note I didnt receive any RFEs for 140)
The BCIS site shows they are processing 485s as of Dec 16, 2001 - do they do this 'in order'? I heard someone got their 485 in 6 months - can that be true, or is that a rumor, because a few of my colleagues are still waiting for their 485 (dated jan 2002).
- Is there a way I can temporarily halt the process?
- I was reading up the forums here, and it occured to me that were I to go Consular now, that would take 3-6 months for the application, a coupla months for the date, which I can then request to postpone, hence I think I can buy about 6-8 months.
- Were my 485 to be approved before I get married, is an independent H1 the only way my spouse can get to US? Are there alternatives?
