HI EVERYBODY!!

I HAVE A QUESTION. MY FRIEND IS GETTING MARRIED TO A H1B NURSE APPROVED. SHE RECEIVED HER VISA SCREEN AND I DON'T KNOW WHEN SHE WOULD RECEIVE HER GC. MY FRIEND WILL BE MARRYING HER AND THE NURSE IS WILLING TO PETITION HER RIGHT NOW.

IS IT STILL POSSIBLE FOR HER TO PETITION MY FRIEND? WHAT ARE THE REQUIREMENTS THE NURSE NEEDS TO PURSUE THESE? MY FRIEND IS HAS A CURRENT STATUS OF H1B ALSO BUT HE WANTED TO BE WITH THE NURSES PETITION.

Please avoid using CAPS, i had to read your post couple of times to understand what you wrote.

From your post, i assume that the nurse is still on H1B and so is your friend. So what petition are you talking about? Also, what do you mean by visa screen and H1B nurse approved?

From what you wrote I gather the nurse has applied for the Green Card.?????????????
If NOT and the nurse has the visascreen and everything else needed they can apply for the GC since Schedule A occupations are current. If they are both just H-1B's and the nurse hasn't applied, is work sponsoring the nurse for a GC.??
It would be easier to add the other person as a Green Card Derivative if they were married first. It's easier from what I have seen then adding the spouse later. Just file both together after they are married.

ok . i really don't know how it works. but here goes...

the nurse is h1b or 245-I . she just got the visa screen and she wants to marry the gut who is currently an h1-b. the guy does not want to pursue hi h1-b anymore, instead he wantsa to be petitioned by his nurse girlfriend when they get married.

is it too late for the guy to be petitioned by the nurse or is it still ok?

the guy will end his h1-b soon and does not plan to renew.
