Hi All,

I have gone thru a divorce process here. And thank God it is over now. I am going to marry a woman in India. I am US citizen and she is Indian. What are all the ways to get her here. I have heard K visa etc. Also would like to know about Fiance visa option. But I am not getting the clear picture. Can someone direct me to links or material which can exactly tell me what to do.

Cheers

I would highly recommend consulting an immigration attorney.

As long as you do your homework and contact the US embassy in India who will help with the legal requirements, I really don't see a need for getting a lawyer. If your case is straighforward, the lawyer will just charge you hefty fees for filling out paperwork.

Err on the side of caution

I'd say get a lawyer's advice.

Initially even I thought a lawyer will be an overkill (based on my experience in bringing my wife here on H-4) for a straightforward case like your's. BUT, it seems you can use some help as the consulates are extra cautious when a US citizen is marrying and bringing a non-citizen here (due to marriage scams etc). A skeptical immigration clerk can spoil your plans for a honeymoon in USA.

Some tips on the document collection based on my H-4 Visa (for wife) experience.

• Get the marriage certificate; get it in English or a certified translation.
• Wedding invitation
• Wedding photographs.
• If she is appearing for the interview with Henna/Mehndi on her hands even better.
• Get the name of the Pundit/Pujari who performed the ceremony. His business card too (if he has one, no kidding).
• “Her” birth Certificate in English.
• All the other documents (mark sheets, degree....). This is to prove that the person you say you married exists and has a history of existing (sounds strange, but it is to consolidate that her documents and the marriage is not fake).
• Make sure every thing on the cert is kosher, no spelling mistakes in anything. (Not even in the printed stuff from the govt.) My wife (H4 visa case) was grilled coz "bridegroom" was spelled "bridgegroom" on the official “printed” certificate. (One Desi clerk convinced the Gora Clerk after looking at the photos/invitation/henna that the marriage cert is not fake).

Good luck and have a blissful married life

Same case but we both are in US

I dont know if this is correct forum to post this and I dont want to hijack your thread. I am an Indian citizen living in US on a work visa and my fiance is american citizen. Our wedding will be in india and I want to know what we need to do to make it legal here in US? I wrote to American Consulate in Delhi and they said, they cannot help us in this matter.

Can anybody help me in this matter. Thanks.
