I am on H1B status and my GC is pending. I have been traveling using Advanced Parole that I got through GC application. I have never got H1B stamped on my passport. I came in USA as F1 status and after completing my bachelor I got H1B in March 99.

I am planning to get married in Bangladesh and would like to bring my wife with H4. Could anyone please let me know the procedures to bring my wife here? Since I do not have H1B stamped on my passport, do I have to get the H1B stamp before I can apply for my wife’s H4? Do I need to make an appointment and If I do then how soon? I heard that I need to make an appointment 3 months before, is it true? How long does it take to complete the whole procedure? I have filled concurrent I-140 and I-485 and the I-140 Notice Date is 8th Aug, 2003. Would it be possible to bring her any other way then H4?

I would appreciate your opinion.

Hi,
based on my best knowledge, first find out if you are on h1b status, as far as i know, if you use AP you loose ur h1b status and will have to work on EAD,thats what attrony told me, may be u need to confirm this first.

just trying to share what I know

Your wife can get her H4 stamped based on your H1b approvals notice. No issues.

After coming to USA, without loosing time, apply 485/EAD and AP for her.

The other possibility would be applying CP for her.

But for any such step, your 485 has be pending. Expect interview for her(very likely).

Did u use EAD ?

If you haven't yet used your EAD for job and your H1B approval is still valid, then you are still on H1. When u go to ur. home country, get a H1 stamp for urself and H4 for ur. wife. Trying to get a H4 for her without you getting a H1 stamp at all can be a bit tricky in some consulates. I heard that atleast Chennai consulate gives problem in this situation.

I was also in the same situation .
I entered in US using my AP after my marriage and my wife H4 got approved with out any problem.

As long as you don't use your EAD . I don't see any problem
